Welcome to Hammer Golf ("Hammer," "the App," "we," "us," or "our"). Hammer Golf is developed and operated by Hammer Golf, Inc.. These Terms of Service ("Terms") govern your access to and use of the Hammer Golf mobile application. Please read them carefully before using the App.
By downloading, installing, or using Hammer Golf, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the App. Your continued use of Hammer Golf constitutes ongoing acceptance of these Terms and any updates we may make to them.
Hammer Golf is a mobile application that helps golfers track scores and calculate settlements across 15 different golf betting formats, including Skins, Nassau, Match Play, Best Ball, Scramble, Wolf, Vegas, Stableford, Modified Stableford, Quota, Dots, Bingo Bango Bongo, Snake, Sixes, and Birdie Pot.
Users enter scores hole-by-hole, and the App calculates who owes whom based on the selected game format and bet amounts.
Hammer Golf is not:
Hammer Golf is solely a scorekeeper and settlement calculator. Any actual payments between users occur entirely outside the App through third-party services such as Venmo, Cash App, Zelle, or cash.
To use certain features of Hammer Golf, you may be required to create an account. When registering, you agree to:
You must notify us immediately of any unauthorized use of your account or any other breach of security.
Free Trial. New users receive a 7-day free trial with full access to all features. Users who sign up with a valid referral code receive a 14-day free trial. No payment is charged during the trial period.
Subscription. After the free trial, continued access requires an active, auto-renewing subscription. Subscriptions are managed entirely through the Apple App Store via StoreKit.
Billing and Cancellation. All billing, payment processing, and cancellation are handled by Apple through the App Store subscription system. To cancel your subscription, use the subscription management settings on your Apple device or through your Apple ID account. Cancellation takes effect at the end of the current billing period.
Refunds. All refund requests must be submitted through Apple in accordance with Apple's App Store refund policies and guidelines. We do not process refunds directly.
Price Changes. We reserve the right to change subscription pricing at any time. You will be notified of any price changes in advance, and the new pricing will take effect at the start of your next billing cycle following the notice period.
You agree to use Hammer Golf in a manner consistent with all applicable local, state, national, and international laws and regulations. Specifically, you agree not to:

Hammer Golf is a scorekeeper and settlement calculator only. The App does not facilitate, process, hold, or transmit any money, funds, or wagers of any kind.
By using Hammer Golf, you acknowledge and agree to the following:
You retain ownership of all data, scores, and content you create or input into Hammer Golf ("User Content"). By using the App, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely for the purpose of providing and improving the App's functionality.
We do not claim ownership of your User Content. This license exists only to enable us to operate the service on your behalf.
The Hammer Golf name, logo, visual design, user interface, underlying code, and all related intellectual property are the exclusive property of Hammer Golf, Inc.. All rights are reserved.
You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse engineer or attempt to extract the source code, except where permitted by applicable law.
Your privacy is important to us. Our collection and use of personal information in connection with Hammer Golf is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you agree to the terms of the Privacy Policy.
We reserve the right to suspend or terminate your account and access to Hammer Golf at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable.
You may delete your account at any time through the App's settings. Upon deletion, your User Content may be permanently removed from our systems, subject to any legal obligations to retain certain data.
Provisions of these Terms that by their nature should survive termination will remain in effect, including but not limited to the Betting Disclaimer, Limitation of Liability, Indemnification, and Governing Law sections.
Hammer Golf is provided on an "as is" and "as available" basis, without warranties of any kind, either exHammer or implied.
To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing:
To the maximum extent permitted by applicable law, in no event shall Hammer Golf, Inc., Hammer Golf, or any of its affiliates, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:
In no event shall our total aggregate liability to you for all claims arising out of or relating to the use of the App exceed the total amount you have paid for your Hammer Golf subscription in the twelve (12) months immediately preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Hammer Golf, Inc. and Hammer Golf from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the courts located in the State of Texas, and you consent to the personal jurisdiction of such courts.
Informal Resolution. Before filing any formal legal claim, you agree to first contact us at support@hammergolf.app and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving your notice.
Binding Arbitration. If the dispute cannot be resolved informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of Hammer Golf shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association ("AAA"). The arbitration shall take place in the State of Texas. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you through the App or via email.
Your continued use of Hammer Golf after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the App.
